ORDER
1. The present writ petition has been filed by the petitioners under Articles 226/227 of the Constitution of India read with Section 482 Cr.PC.praying inter a//a'for quashing of FIR No. 161/2009 lodged under Section 406 IPC at Police Station: Barakhamba Road, New Delhi.
2. Mr. K.K. Manan, Advocate appearing for the petitioners states that the present petition came to be filed on the basis of a settlement arrived at with the respondent No.2/complainant. However, when the respondent No.2/complainant entered appearance through counsel, the stand taken by the petitioners was contested. W.P.(CRL) 1SS9/2010 1 of[2] 2013:DHC:7642
3. Mr. Vijay Aggarwal, Advocate appearing for the respondent No.2/complainant states that it is the stand of the respondent No.2/complainant that though a settlement had been arrived at between the petitioners and the respondent No.2/complainant, the petitioners had not acted on the same.
4. Be that as it may. As it is submitted by the counsel for. the petitioners that the present writ petition has been rendered infructuous on account of the closure report submitted by the State that has been duly accepted by the learned MM vide order dated 31.08.2013, the present petition is disposed of alongwith the pending applications.
