This appeal isdirected against the order dated 08.08.2013 passed by a learned Single Judge of this Court in lA No.7836/2012 in CS(OS)
No.836/2012. The said lA No.7836/2012, which was an application under
Section 8 ofthe Arbitration and Conciliation Act, 1996 (hereinafter referred to as said "Act") filed on behalf ofdefendant Nos.l and 2 ("the appellants" herein), was dismissed byvirtue ofthe impugned order dated 08.08.2013.
Mr Sanjay Jain, learned senior counsel appearing on behalf of the appellants states that he has instructions to withdraw this appeal. He, however, submits that, the time for filing the written statement be extended.
According to the order dated 08.08.2013, four weeks time had been granted
2013:DHC:7367-DB f to the said appellants to file their written statements. That period offour weeks expired on 05.09.2013. In view of the circumstance that the appellants were challenging the said order, we allow this request of the learned counsel for the appellants that time be extended for filing the written statements. The same be now filed within three weeks from today.
The appeal is dismissed as withdrawn with the aforesaid liberty.
