ORDER o/o 03.10.2013 This Court finds no reason to interfere with the order of the learned Single Judge.
It is however, open to the appellant to approach the learned
Single Judge in the light of the submissions made today that the impugned order has not taken into consideration Section 60 ofthe
Code ofCivil Procedure as well as the affidavit filed on l?^*" July, 2013.
2013:DHC:7981-DB It is stated by Mr.Vachher, learned counsel for the appellant that the appellant's additional expenditure of Rs.50,000/- towards his daughter's monthly expenses - in respect of fees and other outgoings, to support other educational needs of his daughters, is a subsequent development which has to be taken note of
In these circumstances, it is open to the appellant to approach the learned Single Judge and file suitable application including an application for review.
The appeal is dismissed as withdrawn but in the above terms.
