No.293/01 titled as "M/s.Shankar Growth Funds Ltd. Vs. M/s.Samiah
International Builders Pvt. Ltd & Ors"] have been filed by the petitioner against the respondents, however, the same are listed before the different courts. It is prayed by counsel for the petitioner that both the matters may be listed before either of the two courts, which would be convenient to both the parties.
Notice in this matter was issued. Despite service and despite the matter being passed over once and called a second time, none is present on behalf of respondents No.2 and 3.
Let both the complaint cases [Complaint case No,160/1/11 titled as
"M/s.Shankar Growth Funds Ltd. Vs. M/s.Samiah International Builders Pvt.
Ltd &Ors." presently pending before the Court of Sh.Nipun Awasthi, Ld.
2013:DHC:8252 M.M. Saket Courts; and (ii) connplaint case No.293/01 titled as
"M/s.Shankar Growth Funds Ltd. Vs. M/s.Samiah International Builders Pvt.
Ltd & Ors" presently pending before the Court of Sh.Manish Khurana, Ld.
MM, Rohini Courts] be listed before the Courts at Saket on 13.12.2013, the date stated to be fixed.
Petition stands disposed of, in above terms.
