08.10.2013 Ultimately, the parties have arrived at a settlement in the following
ORDER
1. It is admitted by learned counsel appearing for the defendant with defendant in person that out of total sale consideration of Rs.1.68 crore, the defendant has already received a sum of Rs.35.00 lakhs from the plaintiff leaving balance amount of Rs.1.33 crore being payable by the plaintiff to the defendant.
2. Afuither sum of Rs.25.001akh has been paid by the plaintiff to the defendant today by way of a Pay Order.
3. It is admitted by the plaintiff that out of the balance sale a terms: I 2013:DHC:6740, I, i[1].[1] lu consideration amount of Rs.1.08 crore, a further sum of Rs.50.00 lakh will be paid by the plaintiff to the defendant by way of a Pay Order on or before 23.10.2013 and also interest thereon as calculated as on date amounting to Rs.8.42 lakh. That balance amount of Rs.58.00 lakh will be paid by the plaintiff to the defendant at the time of registration of the sale deed before the Sub Registrar on or before 25ft Octob er,20I[3]. It is directed that the plaintiff in addition to purchasing stamp papers, will also get prepared a draft copy of sale deed and will hand over to counsel for the defendant a copy of draft within four days from today and both the counsel will formally finalise the terms of the sale deed, which will be finally prepared in consultation with parties, on the stamp papers by the plaintiff and presented before the Sub Registrar on 25th October, 2013.
