438 Cr.P.C. in FIR No.l07/2013 under Sections 308/323/34 IPC, Police Station Deshbandhu Gupta Road, Delhi.

BAIL APPLN.682/2013 & 825/2013 2013:DHC:6907 At the outset Mr. Manoj Ohri,' learned APP appearing on behalf of the State on instructions submits that pursuant to the order dated 26.04.2013 passed in Bail Application No.682/2013 preferred by Rajesh@ Tinda and Sunny and order dated 14.05.2013 passed in Bail Application No.825/2013 preferred by Mukesh, all the three applicants have been formally arrested and released on bail and they have co-operated with the investigation. Briefly stated the case of the prosecution is that on 27.03.2013 an information was received from Lady Harding Medical College that one Manoj, son of Ravidas, has been admitted to the hospital after sustaining injuries. Statement of Manoj was recorded in which he alleged that he is a tenant in House No.9474, Baghraoji Kacha Chowk, Kishan Ganj, Delhi. On the day of Holi at about 2:30PM, the three applicants tried to put colour on the daughter of his landlord to which he objected. Thereupon all the three applicants became annoyed and started beating him. The three applicants are also stated to have beaten one Birbal, grandfather of the girl namely Kajol, when he came out from the house. On his complaint, the subject FIR was registered. In the present case it is observed that all the three applicants have clean antecedents and that there is no other case pending against them. It is further observed that they have already joined investigation and co-operated with ·it. It is also observed that the investigation is complete.
