25.10.2013 By the present petition, petitioners seek transfer of the complaint case bearing No.27/3/02 titled as CBI Vs. Raj Kumar Jain & Ors., pending in the court of Vidya Prakash, Chief Metropolitan Magistrate, Central District, Tis Hazari Courts to the Court of Chief Metropolitan Magistrate, East
District, Karkardooma Courts, Delhi on the ground that for the past almost three years not a single witness has been examined for the reason that the Judge (different Judges, who dealt with the matter) was busy in administrative work.
Heard. It is strange that not a single witness has been examined in this case till date. The trial court is directed to ensure that this matter is not adjourned on the next date of hearing and it is taken up for recording of evidence. It is expected that the trial court will conclude the evidence as expeditiously as possible. Liberty is granted to the petitioner to approach this court again, in case there is no substantial progress in the matter.
Petition stands disposed of, in above terms.
Copy of this order will be brought to the notice of concerned court by the parties. DASTI to counsel for the parties.
