Crl. M.A. 15941/2013 and Crl. M.C. 342/2013 These are applications under Section 482 Cr.P.C. moved jointly on behalf of petitioners and respondent No. 2 for recording settlement.
Photocopy of the memorandum of settlement has been placed on record (original seen and returned). In terms of the settlement, today a sum of Rs.85,00,000/- has been paid by the petitioner to respondent No. 2 by way of four demand drafts bearing Nos. 001836, 001837, 001842 and 001841 dated 17^^ October, 2013, all draw on
HDFC bank (photocopy ofthe same has been placed on record which is acknowledged by respondent No.2). The said amount is received collectively in full and final settlement of all the disputes in the present petitions.
In view of the settlement, respondent No. 2 has no objection to the quashing ofthe complaint case.
Both the parties are directed to remain bound by the terms of the settlement.
In view of the fact that the matter has been settled amicably between the parties by virtue ofsettlement dated 4^ October, 2013, it will be a fiitile exercise to prolong the litigations. As such. f
Complaint Case Nos. 34/2009, 37/2009, 36/2009 under Sections
409/420/468/471/34 IPC pending in the Court of Sh. Gaurav Rao, learned Metropolitan Magistrate, South District, Saket Courts, New Delhi and the proceedings emanating there from are hereby quashed.
The date already fixed i.e. 3'"'^ December, 2013 stands cancelled.
