TR.P.fCRL.) 69/2013 By the present petition, the petitioners seek transfer of CC No.586/1, pending in the Court of Ms.Twinkle Wadhwa, M.M., Saket Court, to the
Court of Ms.Ruchika Singia, M.M., Dwarka Court as CC No.1564/1 of 2011, wherein parties are same, is pending in the Court of Ms.Ruchika Singia, M.M., Dwarka Court.
Notice. Learned counsel for the respondents accept notice. Learned counsel for respondent no.l submits that without admitting any of the averments made in this petition, respondent no.l would have no objection if both the cases are listed in one Court, however, he submits that since
2013:DHC:8255 the stage in both the cases are different, both the cases should not be clubbed together. Learned counsel for the petitioners submits that the petitioners will make such a prayer in the appropriate Court, if advised.
Counsel for respondent no.2 also submits that he has no objection if both the cases are listed In one Court.
Accordingly, as agreed, both the matters (CC No.586/1 and CC
No.1564/1 of 2011) will be listed in the Court of Ms.Twinkle Wadhwa, Metropolitan Magistrate, Saket Court. All legal rights of the parties are kept open.
Petition stands disposed of in above terms.
