29.11.2013 Aftersome hearing, the learned counsel forthe appellant sought liberty to approach the Family Court for recall of the ex parte decree in accordance with law. It has been specifically urged in this context that the appellant did not defend the divorce proceedings because of a settlement whereby she was ensured payment of US$40,000/-, which, according toher, the respondent backed out from atthe eleventh hour.
She claims to have become aware of the ex-parte decree in this case only in October, 2013.
In these circumstances, liberty is granted to the appellant to
2013:DHC:7893-DB approach the trial court With an application for recall or review of the ex parte decree as the case may be, in accordance with law.
The appeal is dismissed as withdrawn with liberty as prayed for.
