dated 30.05.2013 passed by a learned Single Judge of this court in OMP No. 822/2011 which, in turn, was passed in an application filed by the appellant herein under Section 34 ofthe Arbitration and Conciliation Act, 1996 whereby theappellant had sought thesetting aside oftheAward dated
02.07.2011 passed by the learnedArbitrator.
2013:DHC:7068-DB The learned counsel for the appellant submits that he wishes to withdraw this appeal. However, he only requests that the amount awarded to respondent No. 1 (Delhi Jal Board), be permitted to be paid by the appellant in instalments.
The appeal is permitted to be withdrawn and we modify the order passed by the learned Single Judge as also the Award made by the learned Arbitrator to the extent that the amount liable to be paid by the appellant to the respondent (Delhi Jal Board) shall be paid in three monthly instalments to be paid by the end of each of the following months of December 2013, January 2014 and February
