The aforesaid applications have been filed in the three suits, as aforesaid, to record the settlement ofthe parties.
In CS(OS) No. 197/2009, the Executive Director of the plaintiff
Mr.Parminder Chaddha is present. He has also filed his affidavit in support of LA. No. 19606/2013 and has also signed the said application on all pages.
The application is also supported by the affidavit of Mr. Sumeer Mahajan, the Director of defendant No. 1 company, who is also present in Court and confirms the settlement. On the prayer of the plaintiff, defendants No.2 & 3 stand deleted.
The terms of the settlement appear to be fair, just & reasonable, whereunder both the plaintiff Chadha Rubber Pvt. Ltd and Amtel Investment
Holding Pte Ltd. have given up their respective claims against the other.
So far as CS(OS) No. 705/2009 is concerned, defendant No.2 is deleted from the array of defendants, as prayed by the learned counsel for the plaintiff As aforesaid, the parties have arrived at a settlement, the terms whereof have been noticed hereinabove. The application has been signed by the parties, their respective counsel and is supported by the affidavit of
Mr.Sumeer Mahajan, the Director of the plaintiff company and
Mr.Pan-ninder Singh Chaddha, the Executive Director of defendant No.l.
So far as LA. No. 19598/2013 is concerned, once again I find that the same is signed by the parties, their respective counsel and is supported by the affidavits of Mr. Sumeer Mahajan and Mr. Parminder Singh Chaddha.
Allahabad Bank/ defendant No.2 in this suit also stands deleted, as prayed for by learned counsel for the plaintiff
Accordingly, the aforesaid three suits are disposed of, as compromised in terms of the settlement contained in the three applications.
The parties are left to bear their respective Costs.
