02.12.2013 Respondents It is submitted that respondent nos.l, 2 & 3 are no longer marketing the goods under the mark 'Paramax' for the last seven years and since the fourth respondent has stopped manufacturing the saidproduct, indeed it has stopped •activities for the last five years, counsel submits, she has instructions to withdraw the appeal in the light of these developments.
RP'A (OS) 128/2012 is accordingly dismissed as withdrawn along with the pending application.
