06.12.2013 The learned counsel for the appellants seek permission to withdraw this appeal with liberty to file an affidavit of Sh Vilayati Ram Mittal with regard to his non-participation in the arbitral proceedings. It will also be open to the appellants to press their plea before the learned Single Judge, in their petition under Section 34ofthe Arbitration and Conciliation Act (OMP
No. 993/2012), that Sh Vilayati Ram Mittal had not taken any part in the arbitration proceedings and had merely signed the award on the asking of respondent nos. 1 & 2.
The appeal is dismissed with the aforesaid liberty.
