ORDER
2. Learned counsel for the appellant has submitted that earlier the matter was settled for a sum of Rs.35 lakhs before the Ld. M.M. Ld. counsel has referred to the statement of respondent No.2 under Section 313 Cr.P.C. at page 72 ofthe Paper Book wherein respondent No.2 has stated he is ready to 2013:DHC:8364 pay ?35 laklis as per settlement arrived at out ofthe court with complainant.
3. The respondent no.2 is present in the court. He submits that he is cancer patient and not in aposition to pay ?35 lakhs. However, he is ready to settle the matter for asum of^25 lakhs with petitioner.
4. After some negotiations, the parties have settled the matter for a sum ot?25 lakhs. The petitioner is also ready for full and final settlement ofthe matter with respondent no.2 for a sum of?25 lakhs.
5. The respondent no.2 has prayed for making the payment in instalments. The request is considered.
6. Let the respondent pay the settlement amount in five equal monthly instalments. The first instalment shall be paid by 7^^ ofFebruary, 2014. The subsequent four instalments shall be paid by the 7^^ ofevery consecutive month without any default.
7. The statement of respondent no.2 to this effect has also been recorded separately.
8. The impugned judgment of Ld. ASJ stands modified in terms of settlement between the parties. The appeal stands disposed of in terms of settlement between theparties.
9. The respondent No.2 shall remain bound by his statement. CRL.M.A. 12018/2011 (for directions^ In view ofabove order, no orders are required on this application. The same stands disposed of VEENABIRBAL,J DECEMBER 19, 2013 srb
