JUDGMENT

1. Allowed, subject to all just exceptions.

2. The application stands disposed of. W.P.(CRL) 1036/2025

3. This is a petition under Article 226 of the Constitution of India read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS) whereby the petitioners are seeking protection from the respondents.

4. The learned counsel for the petitioners submits that the petitioners are law abiding citizens and are residing in neighbourhood of respondents. The respondent Nos. 2 and 3 are doing illegal activities and are threatening and abusing the petitioners. On 25.1.2025 at about 11 P.M. the window of their house was broken and the petitioners found that respondents No.2 and 3, were responsible for it, and they had caused the damage by throwing bricks and stones on their house. Subsequent thereto, on 14.03.2025 at around 9 p.m., they heard a shooting sound and saw that respondent No.2 was carrying a heavy metal weapon and was challenging the petitioners’ family.

5. He further submits that the petitioners reported the matter to the police but instead of lodging FIR, the police had recorded one NCR at Police Station Ranhola on 16.03.2025 under Sections 324(2)/351 (2) of the BNSS and the respondent No.2 was released, on the same date, in the evening.

6. Learned counsel thus submits that the same had no deterrent effect on the respondents who are still continuing with their illegal acts. He, thus, submits that the petitioners be granted police protection.

Mr. Sanjeev Bhandari, the learned Additional Standing Counsel for the State submits that the incident is of a fight between the neighbours for which two kalandaras have already been registered against respondent No.2 and are pending before the concerned SDM. He further submits that in order to provide protection to the petitioners, the numbers of the SHO and the Division Officer shall be provided to the petitioners, who can contact them in the event of any kind of emergency. The learned ASC, on instructions, further submits that the petitioner No.3 is a serving Constable in the District Dwarka and on the complaints of the petitioners two NCRs have been recorded.

8. In view of the above, in case of emergency, the petitioners can immediately call the concerned SHO and the Division Officer at Police Station Ranhola whose numbers are given as below: SHO: 7065036128 SI Ramesh (Division Officer): 8700041995 SI Rajat Khajwal: 7838932640

9. The learned counsel submits, as of now the petitioners are satisfied with the above arrangement for their security, the petition be disposed of.
