Date of Decision: 27.05.2014 M/S NATIONAL MANUFACTURING CORPORATION LTD..... Petitioner
Through: Mr. P.C. Dhingra, Mr. P.S. Bindra & Mr. P. Choudhury, Advocates.
VERSUS
SHRI KRISHAN KUMAR AGGARWAL ..... Respondent
Through: Mr. Sanjiv Sindhwani, Senior Advocate with
Mr. Amit Andlay & Mr. Arun K.Sharma, Advocates.
CORAM:
HON'BLE MR. JUSTICE V.K. SHALI V.K. SHALI, J.
This is a contempt petition filed by M/s National
Manufacturing Corporation Limited through its partner
Sh.NitinMehra against the respondent/Sh.Krishan Kumar
Aggarwal for having violated the order dated 08.07.2013. By virtue of the order dated 08.07.2013, the respondent was directed to
2014:DHC:2837 restore water supply to the portion of the petitioner subject to the condition that the petitioner shall deposit a sum of Rs.20,000/- with the Registrar General of this court within a period of one week from the date of the order i.e.08.07.2013. It was the case of the petitioner that although Rs.20,000/- was deposited by them with the Registrar General of this court, however, the respondent failed to restore the water supply to the portion of the petitioner. Since appeal i.e.RSA No.113/2010 has already been decided vide a separate order today, I feel that the present contempt notice does not warrant to be proceeded further on this minor point of non supply of the water now. Accordingly, the contempt notice stands discharged. File be consigned to record room.
