Neelam Kapur v. Ashok David and Ors.

1. This order is in continuation of the order dated 24.11.2014, whereunder it was noted that the petitioner has filed the present contempt petition against the respondents for non-compliance of the order dated 24.09.2014.

2. On the last date of hearing, Ms. Sindhwani, learned counsel for the respondent No.3/DOE had stated on instructions that the respondents No.1 and 2/School is an aided minority school and 95% of the grant-in-aid is released by the DOE to the School. She had further submitted that there was some delay on the part of the respondents in calculating the pensionary benefits payable to the petitioner but subsequently, the amount had been finalized. The Court 2014:DHC:7228 CONT. CAS(C) 838/2014 was assured that if granted two weeks’ time, the said amount would be released in favour of the petitioner.

3. Today, Ms. Sindhwani states that a draft for a sum of `2,74,563/- dated 12.12.2014 has been drawn in favour of the petitioner and forwarded to the School for being released to her. She hands over a copy of the said draft with a copy to the counsel for the petitioner. The same is taken on record.

4. The petitioner is granted liberty to approach the School for collecting the said cheque. As for the pension payable to the petitioner, learned counsel for the respondent No.3/DOE states on instructions that the same is ordinarily payable at the end of each calendar month and it will be remitted directed into the petitioner’s account, henceforth.

5. In view of the aforesaid submission, the present petition is disposed of.

6. Needless to state that if the grievance of the petitioner still survives, she shall be entitled to approach the Court for appropriate orders. (HIMA KOHLI) DECEMBER 18, 2014 JUDGE rkb
