14.01.2015 The present petition has been filed by the petitioners under
Section 482 Cr.P.C. for quashing of FIRNo.48/2013, under Section
406/498A/34 IPC, registered atP.S. CAW Cell, Nanak Pura, Delhi on the complaint ofrespondentNo.2, Nazia Sultan.
Brief facts of the case are that the marriage between the petitioner No.l and respondent No.2 was solemnized on 13^ April, 2012 according to Muslim rites and customs. Later on, on 2"^^ July, 2012 the petitioner No.l had pronounced divorce to the respondent
No.2 and the same was received by the respondent No.2 on 3'"'' July,
ORDER
2012. On 13^ July, 2012 a DD No.58B was registered at PS Kamla Market under Sections 107/151 Cr.P.C. and the petitioner No.l was discharged on July, 2012 and then the respondent No.2 approached CAW Cell, Nanakpura, New Delhi, on the basis of which 2015:DHC:10613 -li ( f J the aforesaid FIR was registered on April, 2013 against the petitioner No.l and his family members. During the course of the proceedings, the petitioners and respondent No.2 have settled their disputes amicably by virtue of their Settlement Agreement dated 9^^ January, 2013. RespondentNo.2 is present in the Court and has been identified by the learned counsel. She has confirmed the settlement arrived between the parties and also that she has received bank draft for a sum of Rs.1,30,000/- jfrom the petitioners in terms of the modified Settlement Agreement arrived between the parties on 29^'' November,
2014. The other petitioners No.2 to 5 arenotpresent. She has noobjection ifthe appearance ofthepetitioners No.2 to 5 be dispensed with, in view ofthe fact that the disputes between the parties has already been resolved and the settlement is acted upon between them. She has no objection ifthe prayer made inthe petition is allowed. Considering the peculiar facts and circumstances of the case, the presence of petitioners No.2 to 5 is exempted. In view of the averments made in the petition as well as the settlement arrived at between the parties, the FIR No.48/2013 under Sections 498- A/406/34 IPC registered at P.S. CAW Cell, Nanak Pura, Delhi and proceedings pursuant thereto are hereby quashed quathepetitioners. /i Thepetition is accordingly disposed of.
