15.01.2015 The above mentioned two petitions have been filed bythe petitioners under Section 482 of the Code of Criminal Procedure seeking quashing of
FIRNo.1700/2014 under Sections 323/324 IPC and FIR No.915/2014 under
Sections 323/324 IPC, Police Station Maurya Enclave, North West District, 2015:DHC:10625
> Delhi. The aforesaid FIRs are registered on the basis ofcomplaints lodged by the complainant/respondent No. 2inrespective cases.
It is stated in the petitions that during the pendency of the proceedings, both the parties have settled their disputes with the intervention oftheir parents and elders. Jagree Singh and Raunaq Bhalla are present in
Court who have been identified by the counsel for the petitioner. The parties have no objection if both the FIRs are quashed as they have compromised the matter by virtue of compromise /joint settlement dated 28^ November
2014 which is signed by them.
Although it is a compoundable offence, the petitioners ought to have filed the petition before the trial court, however, in the interest ofjustice, equity and coupled with the fact that both are young boys, this Court is inclined to exercise its discretion for passing the order to quash the above said FIRs.
Inview ofthe averments made inthe petitions and the joint settlement dated 28^^ November, 2014, Iam of the opinion that no useful purpose would be served in continuing theproceedings arising outof the above said
FIRs. Accordmgly, the proceedings arisen jfrom the FIR No.1700/2014 under Sections 323/324 IPC and FIR No.915/2014 under Sections 323/324
IPC, Police Station Mauiya Enclave, North West District, Delhi, are hereby quashed.
Both the petitions stand disposedof Dasti.
