JUDGMENT

1. The present petition has been filed by the plaintiff praying inter alia for leave to withdraw the present suit on the ground that the plaintiff has agreed to settle the dispute with the successor-intitle in respect of the defendants’ shares in the suit property.

2. Counsel for the plaintiff states that initially some of the defendants were represented through counsel, but for the last several dates, none has been appearing on their behalf and presently, the suit is at the stage of recording of plaintiff’s evidence. 2015:DHC:444 CS(OS) 1573/2009

3. The prayer made in the application is allowed and the suit is dismissed as withdrawn.
