27.01.2015 The present application has been filed by the petitioner under Section
438 Cr.P.C. for grant of anticipatory bail in case FIR No.514/2014 under
Sections 308/411/34IPC, registered at P.S. Geeta Colony, Delhi.
It is the case of the petitioner that he has been wrongly dragged and named in the disclosure statements of the co-accused in the present FIR. In fact, he has nothing to do with the alleged incident dated 7* August, 2014.
The petitioner is not named in the FIR. It is also stated that the petitioner resides inthe same locality and ifhe would have been involved inthe crime, he would have identified bythecomplainant.
Learned counsel for the petitioner states that the petitioner undertakes to join the investigation as and when directed to do so. He is also ready to provide his photographs for the purpose ofidentification. Besides, he would make available himselffor the said purpose.
2015:DHC:10561 Earlier, the petitioner's application for anticipatory bail was rejected by the Addl. Sessions Judge by order dated 16^^ September, 2014.
Having heard the learned counsel for the petitioner and the learned
APP for the State as well as considering the overall facts and circumstances of the case, I am inclined to allow the prayer made in the petition. Hence, it is directed that in the event of his arrest, the petitioner shall be released on bail subject to his furnishing a personal bond in the sum of Rs.10,000/- with one surety of the like amount to the satisfaction of the Investigating Officer
ORDER
(10) and further subject to the following conditions:- (a) that he will appear as and when directed by the 10 and continue to cooperate in the investigation; (b)that he will furnish his present address and contact number to the 10 and will not shift from the said address or change the contact number, without prior permission ofthe 10;
(c) that he will surrender his passport to the lO and will not leave the country without permission ofthe Court. In case of violation of any of the conditions above, it will be open to the State to apply for cancellation ofthe bail. The petition is accordingly disposed of.
