JUDGMENT

1. Counsel for the plaintiff states that during the pendency of the present proceedings, the Engineer (Member) of the DDA had appointed an Arbitrator to adjudicate the disputes between the parties, subject matter of the present suit, in terms of clause 25 of the Agreement and pursuant thereto, the parties had appeared before Shri S.S.Jain, SC Arbitrator, DDA, who has reserved the orders. He submits that the Award has yet to be pronounced and in view of the subsequent events, he does not wish to press the present suit, which is accordingly disposed of alongwith the pending applications.
