JUDGMENT
1. Ml'. D.K. Kapoor, Regional Manager and duly constituted attorney of the appellant and Mr. Ravish Chandra Rastogi, Karta ofthe respondent HUF are present in Court with their respective counsels. The mater was passed over on the first call to enable the parties to negotiate a settlement.
2. When the matter was again taken up after pass over, the learned counsel for both the parties submitted that the parties agree to the following terms of settlement:
(i) The appellant shall handover the vacant and peaceful possession of the suit properties, namely. Basement Floor of property No.G-2/16, Ansari u 2015:DHC:12010 \ • \ Road, Daryaganj, New Delhi in RFA 38/2015 and Second Floor of property No.G-2/16, Ansari Road, Daryaganj, New Delhi in RFA 39/2015 to the respondent on or before 31®^ January, 2018 and during this period, the appellant shall regularly pay the damages for use and occupation of both the suit properties consohdated @ Rs.10,000/-per month.
3. Mr. D.K. Kapoor, Regional Manager and duly constituted attorney of the appellant confirms the above settlement and undertakes on behalf of the appellant to honour the same. The undertaking of Mr. D.K. Kapoor is hereby accepted.
4. Both the appeals are disposed of in terms of the above settlement. Both the parties shall remain bound by the terms and conditions of this settlement.
5. This Court appreciates the assistance rendered by Mr. G.P. Thareja and Mr. Manish Vashisht, learned counsels for the both the parties in assisting this Court in resolving an otherwise complicateddispute.
6. Copy of this order be give dasti to counsel for the parties under the signature ofthe Court Master.
