1. \^/rit petitioners in all these petitions are seeking hearing and adjudication of their applications under Section 74(4) of the Delhi Land Reforms Act for declaration of bhoomidari rights in respect of the land which is alleged to be allotted tothem by the Governmentunderthe Twenty Point Programme. The petitioners are also seeking injunction against their dispossession till the decision oftheir applications.
2. Learned counsels for the respondents have taken instructions from the concerned SDM. Learned counsels confinn thatthe petitioners'applications under Section 74(4)ofthe Delhi Land-Reforms Act are still pending and the learned SDM has given them instructions that it would take about six.a months'time to adjudicate them. It is further submitted thatthe Gaon Sabha has fil'.,iproceedings under Section86A ofDelhiLand Reforms Actseeking ejectment ofthe petitioners which are pending before the SDM.It is further submitted that it would be appropriate that the petitioners' applications under Section 74(4)as well as the proceedings under Section 86A ofDelhi Land Reforms Act be heard and decided together.
3. Lf.;arned counsel for the petitioner has no objection to this course of action.
4. In the facts and circumstances ofthese cases,, these writ petitions are disposed of with the direction that the learned SDM shall expedite the W.P(C)238/2015 Page6of[7] hearing ofpetitioners' applications under Section 74(4)ofthe Delhi Land Reforms Act as well as the proceedings under Section 86A ofDelhi Land Ref(:)iTriS Act and endeavour to decide them in a period ofsix months. The pleadings ofthe parties be completed within a period ofeight weeks.
5. Learned counsels for both the parties submit that the parties be directed to appear before the concerned SDM on a fixed date. Let the partie:. appear before the concerned SDM on 02"''' March, 2015 when the learnec SDM shall fix the dates for completion ofpleadings and thereafter for hea.ing the matters.
6. jLcarned counsel for the petitioners submits that ifany adverse orders are passed againstthe petitioners,they may be protected for a period oftwo weeks to enable them to avail the remedies available in law. Learned couns:.4s for the respondents submit that the respondents do not take any coercive action during the period oflimitation for fiftng the appeals.
