JUDGMENT
1. Allowed, subject to all just exceptions.
2. Application stands disposed of. CRL.M.A. 12629/2025
3. By way of the present application under Section 528 of the Bhartiya Nagrik Suraksha Sanhita 2023 (BNSS), the petitioner seeks permission to place on record additional documents which are necessary for adjudication of the present petition.
4. In view of the reasons stated in the application, the application is allowed and the additional documents on behalf of the petitioner be taken on record.
5. Accordingly, the present application stands disposed of. W.P.(CRL) 1344/2025, CRL.M.A. 12631/2025
6. This is a writ petition invoking the jurisdiction of this Court under Article 226 & 227 of the Constitution of India read with Section 528 of the BNSS wherein the petitioner has sought the following reliefs: a. Issue appropriate writ and/ or urgent directions and orders for fair, transparent and timely investigation in the instant matter arising out of FIR No. 405/2023, dated 12.12.2023, registered under S. 341, 323, 307, 302, 34 !PC, at P. S. New Friends Colony, South East Delhi by Central Bureau of Investigation or any other investigative institution; b. Pass adequate orders for fresh and thorough investigation in the instant case on the grounds as mentioned in this application.
7. The learned Standing Counsel for the respondents, who appears on advance notice, submits that the learned Trial Court is regularly monitoring the investigations and the status reports are being submitted before the learned Trial Court.
8. Upon being queried, the learned Standing Counsel submits that the investigation is at the final stage as only the polygraphic test, and if required, then a narco analysis test has to be conducted which may take four months to conclude the investigation.
9. The learned counsel for the petitioner, fairly concedes to the fact that the learned Trial Court is monitoring the investigations.
10. He submits that in case the respondents is able to conclude the investigation in a one or two, he would wish to withdraw the present petition with liberty to approach this Court, in future, if needed.
11. In view of above, the DIU/South-East District is directed to expeditiously conclude the investigations and make an endeavour to file a final report at the earliest, if possible, within three months, before the learned Trial Court.
12. With the above observations, the present petition as well as pending application with liberty as prayed for stands disposed of.
