JUDGMENT

1. Counsel for the plaintiff states that she may be permitted to withdraw the present suit on the ground that the defendant/ITDC does not propose to encash the subject bank guarantee as of now. She however, reserves the right of the plaintiff to institute a fresh suit in case of a fresh cause of action arising in favour of her client.

2. Leave, as prayed for, is granted. The suit is dismissed as withdrawn alongwith the pending applications. HIMA KOHLI, J FEBRUARY 03, 2015 rkb
