12.02.2015 Learned counsel points outthat a rectification application has been made by the appellant in each ofthese matters,which is pending before theITAT. In the circumstance,the Court is ofthe opinion thatthe present appeals should not proceeded with and accordingly dismissed the same with liberty to the appellant to initiate appropriate proceedings in respect of the order in the rectification proceedings. It is also open to the appellant,ifso need be,to urge the grounds pleaded in support ofthe present proceedings, ifthe occasion so warrants.
The appeals are dismissed with liberty as indicated above.
