JUDGMENT

1. Counsel for the plaintiff states that he may be permitted to withdraw the present suit for partition institution against the defendants for the reason that the dispute between the parties has been settled in SC No.85/2012, the succession petition filed by the defendants in respect of the estate of late Shri Rohit Sakhuja (son of the plaintiff, the husband of defendant No.1 and father of defendant No.2). In support of the said submission, a certified copy of the judgment dated 29.11.2014 pronounced by the learned ACJ is handed over and taken on record.

2. The suit is disposed of alongwith the pending applications in view of the aforesaid submission. HIMA KOHLI, J FEBRUARY 27, 2015 rkb
