ORDER
1. Both the parties are present in Court with their respective counsels and they agree to settle the matter on the following terms: (0 The appellant agrees to pay asum ofRs.lO Lacs to the respondent in fiill and final settlement of both these cases. The appellant shall pay Rs.[3] Lacs within a period of four weeks and the balance amount of Rs.[7] Lacs shall be paid in 28 equal monthly instalments of 2015:DHC:11914 Rs.25,000/- each commencing 01^' May, 2015. The post dated cheques shall be handed over along with the demand draft within four weeks.
(II) The appellant shall make the payment ofRs.[3] Lacs by means oftwo demand drafts i.e. for the sum of Rs.[2] Lacs in the name of Ms Chhabra Trading CompanyLimited and for the sum ofRs.l Lac inthe name ofM/s Chhabra Emprorium.
(III) The appellant shall issue six post dated cheques in the name ofM/s
(IV) The appellant present in Court undertakes that all the post dated cheques agreed to be handed over shall be honoured on their first presentation.
(V) The parties fiirther agree that this settlement is subject to the encashment ofthe post dated cheques agreed to be handed over and in the event of any two consecutive defaults, the respondent shall be entitledto execute the two decrees passed bythe learned Trial Court. The undertaking ofthe appellant is hereby accepted. The appellant shall remain bound by the undertaking given to this Court.
3. Both these appeals are disposed ofin terms ofthe settlement between the parties.
4. Copy ofthis order be given dasti to counsel for the parties under the signature of Court Master.
