HON'BLE MR. JUSTICE I.S.MEHTA
25.03.2015
ORDER
1. This batch of writ petitions concern the Craft Instructors in various ITIs/BTC who were appointed on contract basis from time to time. These Craft Instructors have been claiming regularisation and in the earlier OAs preferred by them the learned Central Administrative Tribunal, Principal Bench, New Delhi (hereinafter referred to as the 'learned Tribunal') vide orders dated 20.08.2010 directed the petitioners herein to continue with these Craft Instructors on contract basis and initiate the process of regularisation. The learned Tribunal also directed the petitioners to consider the grant ofage relaxation to these Craft Instructors while considering them for regular appointments. This process was initiated by the petitioners through the DSSSB by an advertisement No.1/2014 dated 20.01.2014 but this again became a subject matter ofchallenge inO.A. No.579/2014.
2. Out of the batch of 128 Craft Instructors, the petitioners have already extended the contractual employment in favour of 113 Craft Instructors, but as regards remaining 15, they have been denied the extension of contractual employment based upon the appraisal report given by the Principals of the respective ITIs/BTC. These 15 Craft Instructors have again approached the Tribunal, either by preferring OAs or by filing Misc. Applications.
3. The petitioners by way of these writ petitions have assailed the interlocutory orders passed by the learned Tribunal in these OAs and during the course of hearing of these matters, we have been apprised that some of the matters are listed before the learned Tribunal on 20*'' April, 2015 and 13*'^ May, 2015.
4. Counsel appearing on behalf ofthe respondents have also apprised the Court that the petitioners neither took any steps to seek stay or vacation of the order of the learned Tribunal nor filed any application seeking early hearing of the cases, but straightaway approached this Courtby way of these writ petitions.
5. Challenge to the interlocutory orders in a writ petition in such circumstances will not be appreciated by the Court and considering the fact that learned Tribunal has yet to take a final view in the OAspreferred by the aggrieved Craft Instructors, we would like to request the learned Tribunal to finally decide the OAs preferred bythese Craft Instructors either on the next date already fixed before it and if not then expectedly within a period of three months from the date of this order. We also direct all the parties to complete their pleadings before the next date so that none of these parties seekadjournment before the Tribunal.
6. The writ petitions and the pending appHcations are disposed of.
