26.03.2015 These are three petitions filed by the petitioners under Section 482
Cr.P.C. for quashing ofthree FIRs registered by them against each other.
One ofthe FIRs is bearing No.125/2010 registered on 28^'' July, 2010, under
Sections 323/324/34 IPC (though the charge-sheet was filed under Sections
307/326/323/147/149 IPC) at P.S. Chhawla, Delhi on the complaint made by
Karam Chand Tyagi (respondent No.2 in Crl. M.C. No.3629/2014); the second FIR is bearing No.148/2010 registered on 26'^ August, 2010, initially under Sections 279/338 IPC but later on converted to Sections 325/34 IPC, at P.S. Chhawla, Delhi on the complaint made by Sachin (respondent No.2 in Crl. M.C. No.3928/2014), whereas the third FIR is bearing No.33/2010 registered on 5^^ March, 2010, under Sections 452/354/506/509/323/34 IPC, at P.S. Chhawla, Delhi, on the complaint ofSmt.Sunita (respondent No.2 in
Crl. M.C. No.3804/2014).
During the pendency of the proceedings, with the intervention of common friends, relatives, well-wishers and respectable persons of the locality, the parties have settled their disputes amicably. The original
Compromise/Settlement Deeds dated 4^"^ June, 2014 and 26^^ August, 2014 are placed on the records which are duly signed by the respective parties.
They are also present in Court and are duly identified by their respective counsel. They have confirmed the said settlement. Respondent No.2 Karam
Chand Tyagi in Crl. M.C. No.3629/2014 was present on the last date. He is
86 years old and is suffering from cancer. He wanted that the dispute be resolved during his lifetime.
Considering the peculiar facts and circumstances ofthe case, in order to maintain peace and harmony between the parties and in view of the averments made inthe petitions as well as the settlement arrived at between the parties, all the three FIRs, i.e. (i) bearing No.125/2010 registered on 28^^
July, 2010, under Sections 323/324/34 IPC (though the charge-sheet was filed under Sections 307/326/323/147/149 IPC) at P.S. Chhawla, Delhi;
(ii) bearing No.148/2010 registered on 26^^ August, 2010, initially under
Sections 279/338 IPC but later on converted to Sections 325/34 IPC, atP.S.
Chhawla, Delhi and (iii) bearing No.33/2010 registered on 5* March, 2010, under Sections 452/354/506/509/323/34 IPC, at P.S. Chhawla, Delhi, and proceedings pursuant thereto are hereby quashed qua the respective petitioners, subject to the condition that all of them shall furnish their personal bonds of good conduct for aperiod of two years, before the SHO concerned, within fourweeksfrom today.
The petitions are accordingly disposed of Dasti.
