JUDGMENT

1. The present application has been filed by the plaintiff stating inter alia that the parties have arrived at an out of court mutual settlement in terms whereof, the defendant No.1 has paid a sum of `25,00,000/- to the plaintiff in full and final settlement of all its claim and therefore the plaintiff does not wish to pursue the present suit against the defendants any further.

2. Counsel for the defendant No.1 confirms the aforesaid position and states that he does not have any objection to the present application being allowed. CS(OS) 2621/2010 2015:DHC:3133

3. Accordingly, the present application is allowed and the suit is dismissed as withdrawn.

4. The date already fixed in the suit, i.e., on 21.4.2015 stands cancelled.
