JUDGMENT
1. The petitioner challenges his transfer to Telangana on the ground that he has an autistic child and as per extant policy, he cannot be transferred to such a posting.
2. Admittedly, the petitioner has preferred a representation to the respondent which is pending.
3. Learned Counsel for the respondents on instructions from Mr. Ajay Pal, Law Officer, is agreeable to the disposal of the writ petition with a direction to the respondents to decide the representation within two weeks from today. W.P.(C) 5722/2025
4. Accordingly, the writ petition is disposed of with a direction to the respondents to decide the representation submitted by the petitioner within two weeks from today. The decision as and when taken shall be communicated to the petitioner.
5. The operation of the decision, if adverse to the petitioner, shall remain in abeyance for one week, in order to enable the petitioner to seek legal remedies, if so advised.
6. Mr. Gautam places reliance on DOPT OM dated 17 November 2014 and 6 June 2014, annexed as Annexure P-2 to the writ petition. The respondents would also keep in mind the said OMs while taking a decision on the petitioner’s representation.
7. If the petitioner already stands relieved, the order shall stand stayed for the aforesaid period.
