08.04.2015 Mr. Kapur, learned counsel for the petitioner fairly states, on instructions, that he does not wish to pursue these petitions and accepts the impugnedjudgments. However,he statesthat in respectofthe two vehicles, which were stolen,the petitioner has not been able to receive the insurance claim on account ofnon-submission ofcertain documents. He submits that the respondent should cooperate with the petitioner so that the insurance claim can be processed.
Learned counsel for the respondent states that in terms of the mediated settlement arrived at between the parties, the respondent has already delivered the documents as per the settlement dated 09.08.2012, 2015:DHC:11982 except the copy ofthe driving license. The same has also been recorded by the learned Magistrate. Learned counsel for the respondent, however, assures that the respondent is even now ready & willing to cooperate with the petitioner by providing the driving license and any further documents, which may be available with the respondent and which may be required for processing the claim of the petitioner in respect ofthe two lost vehicles, however,thesameshallbewithoutcreating any liability ontherespondent.
Since the petitioner has voluntarily stated that the petitioner does not wish to pursue these petitions, the directions issued by the learned
Magistrate for initiation ofseparate inquiry under Section 340 Cr.P.C.is set aside.
The petitions stand disposed ofin the aforesaid terms.
