09.04.2015 During the course of hearing the present matter, the counsel for the appellant has apprised this Court that in a separate case filed by this appellant under Section 12 of the Domestic Violence Act, the District
Magistrate, Jaipur vide order dated 18th December, 2014 has already fixed the maintenance amount at the rate of Rs.7,000/- per month taking the income of the respondent at Rs.27,577/- per month. Counsel representing the respondent, on instructions, submits that the said order passed by the
District Magistrate, Jaipur is likely to be challenged by the respondent.
After some arguments, counsel for the appellant seeks to withdraw the present appeal. Counsel also states that at least directions be given to the respondent that he should continue to pay the interim maintenance as has been allowed by the learned Trial Court. Counsel for the respondent
2015:DHC:11665-DB APRIL 099 2015 km -J (6 submits that the respondent has already paid the interim maintenance amount till February, 2015 in compliance of the order dated 15.10.2013 and the respondent shall continue to pay the same at the said rate to the appellant without committing any default.
The present appeal filed by the appellant is accordingly dismissed as withdrawn.
