JUDGMENT

1. The present joint application has been filed by the parties stating inter alia that the suit may be decreed in terms of the settlement arrived at between them and recorded in para 3 of the application.

2. The defendant has given certain undertakings to the plaintiffs as recorded in para 3 of the application. In view of the said undertakings, the plaintiffs have agreed to forgo all their claims against the defendant as prayed for in the suit.

3. The Court has perused the application. The same has been signed by the authorised representatives of the parties and their respective counsels. Enclosed with the application are the affidavits of the constituted attorney/authorised representative of both sides. 2015:DHC:3246 CS(OS) 1829/2014

4. As counsels for the plaintiffs and the defendant jointly state that they have arrived at the aforesaid settlement of their own free will and volition and without any undue influence or coercion from any quarters, there appears no legal impediment in accepting the settlement.

5. The application is taken on record. The parties shall remain bound by the terms and conditions of the settlement recorded therein. The suit is decreed in terms of the settlement recorded in the application, while leaving the parties to bear their own costs.
