JUDGMENT

1. Pursuant to issuing court notice of default, counsel for the plaintiff enters appearance and states that the parties have arrived at a settlement in the present suit as also in some other litigations between the parties, through the Delhi Mediation Centre, Tis Hazari Courts. He hands over a copy of the settlement report dated 30.6.2014 and states that in terms of the said settlement, the defendant had agreed to pay a sum of `42.00 lacs to the plaintiff in full and final settlement of all the claims, subject matter of the cases referred to in the settlement report.

2. Counsel for the plaintiff states that the aforesaid amount was to be paid in instalments, as detailed in para 4 of the settlement report and part amount has been received by his client. CS(OS) 1488/2012 Page No.1 of 2 2015:DHC:3221

In view of the fact that the parties have arrived at a settlement through court annexed mediation, in terms of the proceedings dated 3.6.2014 recorded before the Delhi Mediation Centre, Tis Hazari Courts, the present suit is disposed of. The copy of the Settlement Report dated 3.6.2014 is taken on record.
