JUDGMENT

1. An adjournment slip has been circulated on behalf of the plaintiff without a NOC from the other side.

2. Counsel for the plaintiff states that the present suit may be disposed of in terms of the Circular dated 7.8.2014 issued by the Ministry of Law & Justice, Government of India informing all Ministries, Departments, PSUs and Boards that they should desist from initiating inter-ministerial/departmental litigation in the courts of law and instead, try to resolve their dispute amicably through mutual consultation through the Empowered Agencies of the Government or CS(OS) 1975/2013 Page No.1 of 2 2015:DHC:3420 through arbitration and if the same does not get resolved, then the said dispute be referred, in the first instance, to the Cabinet Secretariat and if necessary, to the PMO.

3. Counsel for the defendants states that he has no objection to the aforesaid suggestion.

4. Accordingly, without prejudice to the rights and contentions of the parties, the present suit is disposed of, while granting liberty to the plaintiff to approach the appropriate forum as prescribed in the Circular dated 7.8.2014 for seeking redressal of its grievance against the defendants.
