Present petition has been instituted by petitioner, who is the husband of respondent no.5, under Article 226 of the Constitution of India read with Section 482 of the Code of Criminal Procedure, seeking a direction to respondents no.l to 4 to release his wife, namely, Neha, (respondent no.5) from the illegal detention of respondent no.4, and hand over her to the petitioner. The petitioner also seeks a direction to provide adequate police protection to the petitioner and his family members as the petitioner apprehends honour killing of the petitioner, his wife and other family members.
Notice. Learned counsel for the respondent accepts notice.
We have heard learned counsel for the parties, petitioner, respondent no.5 and parents of respondent No.5, who are present in
Court, in the Chamber. Respondent No.5 submits that she does not wish to join the company of the petitioner.
2015:DHC:11630-DB Learned counsel for the petitioner submits that the family members of respondent No.5 have been making threatening calls to the petitioner.
Respondent No.4 submits that he has never made any threatening calls to the petitioner and undertakes to the Court that he will not do so in future.
Respondent no.4 shall remain bound by the undertaking given to Court.
Learned counsel for the parties agree that in view of the peculiar facts of this, present petition may be disposed of with the following agreed terms:
(i) Parties will co-operate with each other for annulment of marriage.
(ii) Both the parties will withdraw all the complaints made against each other.
(iii) The parties will not cause any hindrance in the day-to-day life of each other.
Accordingly, petition stands disposed of in above terms. Parties will remain bound by the aforestated agreed terms.
Acopy of this order be given dasti to counsel for the parties.
