These are two petitions filed by the petitioners under Section 482
Cr.P.C. for quashing of two cross FIR Nos.435/201 1 & 436/2011, both under Sections 147/149/323/427 IPC, at Police Station Amar Colony, New Delhi.
Brief facts of the case are that on 10th November, 2011, a quarrel took place between the parties in which both the sides suffered injuries. On the basis of the complaint made by Ram Das (respondent No.3 in Cr!. M.C.
No.1721/2015), the FIR No.435/2011 was registered against petitioners, namely, Jaswinder Singh @ Jassu, Jagjit Singh, Manpreet Singh @ Happy, Harjinder Singh and Rich Pal Singh. Surjeet Singh Bhasin (respondent No.3 in Cr!. M.C. No.1712/2015) also made a complaint in respect of the same incident, on the basis of which the FIR No.436/2011 was registered against the petitioners, namely, Raj Singh, Rajiv @ Ruji, Manoj, Praveen and
Vishal.
Since the parties are residing in the same locality, subsequently, with the intervention of the respectable elder persons of the locality, the parties have settled their disputes amicably. They are also present in Court and have confirmed the settlement.
Considering the facts and circumstances of the case, in order to maintain peace and harmony between the parties and in view of the averments made in the petitions, the FIR Nos.435/201 1 & 436/2011, both under Sections 147/149/323/427 IPC, at Police Station Amar Colony, New Delhi and proceedings pursuant thereto are hereby quashed qua the respective petitioners, subject to the condition that all the petitioners in both petitions shall furnish personal bonds for good conduct before the 10 for a
(D period of two years. They shall additionally undertake therein that during this period, they shall maintain good behaviour and character in future in the society and shall not indulge in any such activities as have been mentioned in the subject FIRs. The aforesaid bonds shall be filed by them within four weeks before the SHO concerned. Copy of the same also be filed before the trial court.
The petitions are accordingly disposed of Dasti.
