ORDER

1. Learned counsel for the Appellant states that the Appellant is prepared to pay any reasonable fees that may be fixed by the Court in addition to the fees of Rs.40,000 that has already been paid to the learned Arbitrator in terms ofthe order already passed by the Court on 7*^ November 2012. The Respondent having already deposited its share of Rs.1,53,750 with the learned Arbitrator the Appellant is directed to deposit an identical sum with the learned Arbitrator within four weeks from today, and in any event not laterthan31®^ May2015, along withcosts ofRs. 10,000.

2. Subject to compliance by the Appellant with the above order, the order ARB.A. 37/2014 page 1 of[2] 2015:DHC:11783 dated 17^^ November 2014 passed by the learned Arbitrator is set aside and one more opportunity is given to the Appellant to cross-examine PW-1 who shall remain present on the date that the learned Arbitrator may fix after 3V' May 2015. Itis made clear that there will be no fiirther requirement of fees to be paid by either party as except as perthe orders ofthe Court.

3. Considering that there is already a time bound direction issued by the Court on November 2012, the learned Arbitrator is requested to complete the proceedings within aperiod ofthree months after 31'^ May 2015, without requiring either party to pay any further fees or charges.

4. Thepetitionis disposed of Dasti.
