JUDGMENT

1. The parties have amicably resolved all their disputes.

2. The appellant has filed CM No. 8979/15 for permission to withdraw the appeal interms ofthesettlement.

3. The terms of the settlement has been placed on record along with application. As per the settlement agreement, the 50% of the decretal amount deposited by the appellant with the Registrar General ofthis Court in tenns of order dated 20"" September, 2007 is to be shared equally by the parties.

4. CM No. 8979/15 is allowed and the appeal is disposed of interms ofthe settlement. The Registry shall release 50% of the amount deposited by the appellant along with interest accrued thereon to the appellant and balance 50% to the respondent within a period ofthree weeks.
