DAWOOD AHMAD DAR ..... Petitioner
Through: Mr. Harit Chhabra, Advocate
Through: Ms. Suparna Srivastava and Mr. Neelmani Pant, Advocates for R-1 & 2
JUDGMENT
1. Ms. Srivastava has reverted with instructions. She says that at the point in time when the passport was first issued to the petitioner’s daughter i.e., Summer Dawood Dar, the birth certificate issued showed her date of birth as 14.02.2001. The said certificate, according to Ms. Srivastava, was apparently issued by the Govt. of NCT of Delhi.
2. It is to be noticed that the Government of NCT of Delhi (East Delhi Municipal Corporation), has issued yet another birth certificate, which shows, the date of birth of Ms. Summer Dawood Dar, as 25.09.2001.
3. The prayer in the writ petition is to correct the date of birth to 25.09.2001, in the passport which, respondent no.2 has been called upon to re-issue.
4. In these circumstances, the writ petition is disposed of with a direction to respondent no.2 to carry out an enquiry and ascertain as to which is the W.P.(C) 3428/2015 2015:DHC:4353 correct date of birth.
5. The decision in the matter with regard to re-issuance of a passport will obviously depend upon the result of the enquiry. In any event, after the enquiry is completed; a copy of the order will be despatched to the petitioner.
6. In case, any further documents are required, respondents will be free to call upon the petitioner to furnish those documents to them.
7. There will be no order as to costs.
