Surinder Kumar Arora v. Santosh Kumar Arora

1. The present case has been placed before the Court by the learned Joint Registrar, who has recorded in the order dated 20.4.2015, that none has been appearing for the plaintiff for the last several dates.

2. A perusal of the order sheets reveals that the plaint was registered on 3.1.2014 and summons in the suit and notice in the interim applications were issued to the defendant, returnable on 9.1.2014. On 9.1.2014, counsel for the defendant had entered appearance and was directed to file the written statement and a reply to the interim application. With these orders, the case was adjourned to 19.3.2014. 2015:DHC:4364 CS(OS) 24/2014

3. The defendant had filed a written statement on 30.1.2014, whereafter vide order dated 19.3.2014, the parties were granted time to file their original documents and the case was placed before the Joint Registrar on 9.7.2014, for admission/denial of the documents.

4. After 19.3.2014, none has been appearing for the plaintiff, nor has any replication/rejoinder been filed by the plaintiff. The original documents have also not been filed by him. The position has remained the same for the last five dates.

5. Today, Mr. Jagjit Singh, Advocate appears for the plaintiff and states that his client has not been giving him any instructions.

6. It appears that the plaintiff is not interested in prosecuting the present suit, which is accordingly dismissed for non-prosecution, along with the pending application. HIMA KOHLI, J MAY 15, 2015 sk
