266/1/12 [Crl.M.C.No.3501/2014], under Section 138 of The Negotiable
Instruments Act, 1881 titled Gitanjali Travels v. Prognosyse & Ors. and the summoning order of 23'"'' January, 2013 is sought on merits in these petitions.
At the hearing, it was disclosed by learned counsel for petitioners that Notice under Section 251 of Cr.P.C. has not yet been framed and the nextdate before trial court is 1^' July, 2015.
Learned counsel for respondent fairly submits that the subject matter of these petitions can be amicably resolved through mediation as the civil proceedings between the parties are already pending.
Let parties approach the trial court with applications praying for referring the matter to mediutior! and for this purpose the parties will appear in the Court of Ms. Vrinda Kumari, Additional District Judge, Patiala House Courts in CS No.361/2014 on 28"^ May, 2015.
All the three petitions are accordingly disposed of with direction that till the arguments on the point of framing of Notice under Section
251 of Cr.P.C. are concluded, personal appearance of petitioners be not insisted upon by the trial. It is made clear that if petitioners delay the proceedings before the triar'Court, then petitioners will not have the benefit of exemption from personal appearance extended by this Court.
