JUDGMENT
1. Learned senior counsel for the appellant on instinotions fioni Mr.Rakesh Kumar, Director ofthe appellant submits that the appellant has decided to handover the vacant and peacefal possession of the suit property to the respondent on or before July, 2015. Learned senior counsel foi the appellant further submits in view of the decision of the appellant to handover the vacant and peaceful possession of the suit property to the respondent, the appellant does not press these appeal. Learned senior counsel for the appellant further submits that suits with respect to the mesne 2015:DHC:12012 profits are pending before the Trial Court which shall be contested by the appellant. Learned senior counsel for the appellant submits that the appellants are contemplating to file a suit for recovery against the' respondent for claiming the amounts due to them.
2. Learned senior counsel for the respondent submits that no amount is due by the respondent. Learned senior counsel for the respondent lurther submits that the undertaking ofthe appellant berecorded.
3. Ml-. Rakesh Kumar, Director ofthe appellant undertakes to handover the vacant and peaceful possession of the suit property to respondent on Oi before July, 2015.
4. The undertaking ofthe appellant is accepted.
