Brieffacts ofthe case are that Mrs. Deepika Garg is the wife of
Abhinav Garg. Vinod Garg is the father of Abhinav Garg. Suresh
Bansal is the father of Mrs. Deepika Garg. The above mentioned petition Crl. M.C. No.2186/2015 have been filed for quashing ofFIR
No.216/2012, under Sections 498-A/406/342/323/509/34 IPG, registered at P.S. Ashok Vihar, Delhi on the complaint ofrespondent
No.2.
On the complaint of respondent No.2 Vinod Kumar Garg, father of Abhinav Garg FIR No.85/2004, under Sections 177/ 182/
468/ 193/471/ 196/ 34 IPG was registered at P.S. Ashok Vihar, Delhi.
The facts ofboth the cases are that Abhinav Garg and Deepika
Garg got married on 22"'' May, 2011 according to Hindu rites and ceremonies. Amale child namely Dhganvi Jai Garg was bom on 6"^
March, 2012.
Due to temperamental differences, they are living separately from each other since 12^'^ August, 2012. In the meanwhile, on the basis of the complaint made by Deepika Garg, the aforesaid FIR
No.216/2012was registered against the petitioners on 29^^ August,
ORDER
2012. Various litigations were initiated between the parties and cross FIR No.85/2014 was also registered on the basis ofcomplaint lodged by Vinod Garg i.e. father ofAbhinav Garg. Durmg the pendency of the proceedings, the disputes between the parties were resolved on the basis ofjoint statements made by Abhinav Garg and Deepika Garg in the Court of Principal Judge, Family Court, Rohini Court, Delhi in Divorce Petition and as well as in Contempt Petition No.42/2013 and Maintennance Petition No.342/2014. The same have also been disposed of. Petitioner No.l Ahinav Garg have deposited a sum of Rs.[9] lacs on 29^^ September, 2014 (Rs.[5] lacs) and on 9'^ October, 2014 (Rs.[4] lacs) which were still lying in trial Court which were converted in the form ofFDR. As per settlement this money is to be utilized in favour ofDeepika Garg who is present in the Court today and submits that she has no objection if FIR No.216/2012 be quashed on the basis of settlement arrived at between the parties. Similarly, Vinod Garg, father of Abhinav Garg has also no objection ifFIRNo.85/2014 is quashed. Considering the facts and circumstances ofthe case, in order to maintain peace and harmony between the parties and in view ofthe averments made in the petitions, the FIRs No.216/2012, under Sections 498-A/406/342/323/509/34 IPC, registered at P.S. Ashok Vihar, Delhi and FIRNo.85/2004, under Sections 177/ 182/ 468/ 193/ 471/ 196/ 34 IPC, registered at P.S. Ashok Vihar, Delhi and proceedings pursuant thereto are hereby quashed qua the respective petitioners. Parties are bound by the terms and conditions of the settlement. The amount ofRs.[9] lacs lying with the trial Court shall be released to Deepika Garg including interest ifany accrued. The petitions are accordingly disposed of. Dasti. t,J. MAY 28, 2015
