09.07.2015 for the parties jointly state that pursuant to the settlementAgreementdated 26.3.2015arrived between the parties at before the Delhi High Court Mediation & Conciliation Centre, the dispute between them stands resolved and the defendants have agreed to execute a sale deed In respect of a part of the parcel of land,subject matter of the Agreement to Sell dated 1.3.2013,for a consideration thathas already been paid bythe plaintiff.
JUDGMENT
2. Counsel for the plaintiffstates that the parties have discharged their respective obligations under the Settlement Agreement dated 26.3.2015and his clients do not wish to pursue the presentsuit any further.
3. in view ofthesubmission made bythe counselforthe plaintiff, CSCOSJ 2425/2013 Page 1 of[2] 2015:DHC:11879 theSettlementAgreementdated 26,3.2015istaken on record and the suitis disposed of,along with the pending application.
4. Atthisstage,learned counselforthe plaintiffstatesthatin view ofthefactthatthe parties have arrived ata settlementthrough court annexed mediation,the plaintiffis entitled to claim refund ofthe court fees in terms ofSection 16ofthe Court Fees Act.
5. In view of the fact that a settlement has been arrived at between the parties atthe initial stage,ofthe suit, much priorto the stage offraming ofissues,the Registry is directed toissue a certificate in favour ofthe plaintifffor refund ofthe courtfees underSection 16 of the Court Fees Act.
6. Thesuitis disposed of,along with the pending applications.
