Crl.M.C. No.2722/2015 CrLM.C. No.2738/2015 These are two petitions seeking quashing of two separate FIRs.
FIR No.685/2015 has been registered under Sections
506/509/451/354D/34 of the IPC at police station Han Nagar; this was on the complaint of respondent no.2 'V' who is present in Court.
Her presence has been identified by the Investigation Officer. The second FIR i.e. the FIR No.692/2015 registered under Sections
323/341/354/356/379/506/509 of the IPC at the same police station i.e. Han Nagar on the complaint of AK". Complainant is present in
Court. Her presence has been identified by the Investigating Officer.
Parties are neighbours. It is stated that due to a misunderstanding and mis-apprehension the incident had been reported to the police. Living in the same vicinity, parties have IiOW amicably settled all their disputes. This was with the intervention of the elder members of the respective family of the parties. A written
4 compromise deed in both the respective petitions has been placed on record. Parties are present in person. They endorse this factum. It is pointed out that in this background no useful purpose would be serve in continuing these FIR proceedings.
Learned Public Prosecutor states that the State has incurred expenditure and the investigation has progressed. If the FIRs are at all permitted to be quashed it should be subject to payment of costs.
Accordingly. in the interest of justice as also in the larger interest of the society noting the submissions of the parties both the
FIRs (FIR No.685/2015 registered under Sections
506/509/451/354D/34 of the IPC and FIR No.692/2015 registered under Sections 323/341/354/356/379/506/509 of the IPC both at police station Han Nagar) and all the proceedings emanating therefrom are quashed subject to payment of Rs.25,000/- in each petition to be deposited by the petitioners with the Delhi High Court
Legal Services Committee.
